Mandatory supervision or conditional release can place a person in the community before the MDD while correctional control continues. Actual release is the recorded physical event. Discharge may mark the end of custody or supervision when the governing record says so. A Lincoln County search is accurate only when these dates keep their own labels.

Lincoln Release Date Calculation

For an eligible adult committed to the WVDCR Commissioner, the calculation begins with the maximum indeterminate term or the fixed determinate term. Lawful presentence jail credit is applied. Under West Virginia Code §15A-4-17, an eligible person generally earns one day of good time for each day physically incarcerated, including eligible credited presentence days. Eligible felony inmates may receive up to 90 days for each approved optional academic or vocational program. Those possible credits should not be assumed before they appear in the official computation.

Why Lincoln MDD Dates Change

Lincoln County's key computation issue is that MDD is not frozen. Good time can be forfeited after discipline and later restored under the governing process. West Virginia research found no general rule requiring all state offenders to serve 85 percent of a sentence. That shorthand is often linked to the federal system and should not be imported into a Lincoln County state or regional-jail calculation. Lincoln Conditional Release Dates

Good time can affect more than one date. For certain offenses, part of accumulated good time is converted into a period of mandatory post-release supervision. Lincoln Jail Release Computations

Western Regional Jail houses people in more than one legal posture. A pretrial Lincoln detainee has no good-time-based projected release date because the court case has not produced a custodial sentence.
